Have non-compete for software sales and interface to other vendors.

I work for a software company that sells to home care, hospice and public health. This software is designed to be used on laptop computers for nursing home visits. I have an opportunity to work for a company that sells telemedicine devices that they place in the home to monitor ailements like CHF, COPD, and diabetes. We do not sell telehealth equipment but we do interface to two telehealth device vendors. I have signed a non-compete and been with this company for 9 plus years but because the will not promote me, I want to take a position with a telehealth vendor. Would I be breaking my non-compete agreement. Remember, we do not sell telehealh, but we do interface to 2 telehealth vendors.

Non-Compete Issue

The question you pose cannot be answered without a thorough review of the language of the non-compete, the circumstances of your execution of the non-compete, and a detailed discussion about businesses involved. Although non-compete agreements are not favored by the courts, if they are deemed valid and applicable to the circumstances at hand, the courts will not hesitate to enforce them.
