Got severance, denied unemployment. Can I win?

I am being denied unemployment because the company has stated that I was discharged, but I was told I was laid off.

-I worked for a subsidiary company in with 65 employees with a much larger parent company that handled the HR and benefits.

-I was given a letter stating that my position was being eliminated and therefore my employment was terminated, along with some others. I was also given severance in accordance with the parent company's policy, which specifically states that you are only entitled to severance if your position was eliminated or there was a reduction in the workforce.

What are my chances of getting my unemployment benefits?

Sounds to me like you have documentation to show that you left work because the employer eliminated your position. That is a classic type of case where you should be able to receive unemployment. You should certainly appeal and ask for a hearing. I am not able to represent you at this time, but I might be able to recommend someone if you would like assistance from a lawyer.
